Consent to the Processing of Personal Data

This is a translation for convenience; the Russian version is legally binding.

This consent, in accordance with Article 9 of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”, is given by a natural person who registers with or uses the ModelMesh service on the website modelmesh.shop (hereinafter, the “User”) to the operator — Individual Entrepreneur Teterin Pavel Alekseevich (TIN 343526476218, OGRNIP 324774600607451, address: Moscow, Russia) (hereinafter, the “Operator”).

The consent is given freely, of the User’s own will and in the User’s own interest, separately from other documents and statements that the User confirms (the public offer and others), by ticking a separate checkbox in the registration or login form.

Consent to receive advertising and informational mailings is not included in this document and is given separately.

1. Purposes of Processing

  1. 1.1

    The User consents to the processing of personal data for the purposes of:

    • registration, identification and authentication, logging in to the account;
    • provision of the ModelMesh services;
    • acceptance of payments, processing of refunds and fiscal receipts;
    • responding to inquiries and support;
    • ensuring security and preventing abuse;
    • sending service messages.
  2. 1.2

    Processing that is necessary for the conclusion and performance of a contract (public offer) to which the User is a party is carried out by the Operator without consent — on the basis of clause 5 of Part 1 of Article 6 of 152-FZ, as described in the Personal Data Processing Policy (modelmesh.shop/legal/privacy). This consent does not extend to such processing, and the conclusion of the contract does not depend on it.

2. List of Personal Data

  1. 2.1

    The consent extends to the following data:

    • email address;
    • name, nickname, identifier and profile picture from third-party login services (Google, Yandex, Telegram) — if the User logs in through them;
    • information about the account, token balance, subscription, payments and transaction history;
    • the content of requests, generation results and files uploaded by the User — to the extent that they contain personal data;
    • IP address, information about the browser and device, cookies, date and time of requests.

3. Actions with Data

  1. 3.1

    The User permits the Operator to perform the following actions with personal data: collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (provision, access) to the third parties specified in this document, anonymization, blocking, deletion and destruction — both with and without the use of automation tools.

4. Transfer to Third Parties

  1. 4.1

    The User agrees that the Operator may transfer data:

    • to the YooKassa payment service — for accepting payments, refunds and processing receipts;
    • to organizations that ensure the operation of the service on behalf of the Operator (hosting, email delivery, monitoring), on terms of confidentiality;
    • to neural network providers — the content of the request and uploaded files necessary for generation;
    • to state authorities — in the cases provided by law.
  2. 4.2

    The User consents to the cross-border transfer of the content of requests to neural network providers located outside the Russian Federation, including in states that may not ensure adequate protection of the rights of personal data subjects.

5. Term of Validity

  1. 5.1

    The consent is valid from the moment it is given until the purposes of processing are achieved or until it is withdrawn.

  2. 5.2

    After deletion of the account, the Operator ceases processing and deletes the data within the periods specified in the Personal Data Processing Policy (modelmesh.shop/legal/privacy); data that the law requires to be retained is kept for the established periods.

6. Withdrawal of Consent

  1. 6.1

    The User may withdraw the consent at any time by sending a statement by phone +7 961 674-10-00 or via the support chat / Telegram in your personal account, or to the address: Moscow, Russia.

  2. 6.2

    Upon receipt of the statement, the Operator ceases processing and destroys the data within no more than 30 days, unless it has another lawful basis for processing. Withdrawal of consent makes further use of the service impossible.
